eDiscovery Developments, ESI, and Preservation

2018 ushered in a number of key eDiscovery developments of which clients and counsel should be aware in 2019. These developments include key procedural points regarding ESI search protocols and data preservation issues, technological advances influencing the discovery of relevant communications, and updates to technology-assisted review (TAR) case law. This program will address these developments and spotlight recommendations for addressing the issues.

Topics covered include:

  • The role of custodian interviews in satisfying preservation and production standards
  • New developments affecting the use of non-waiver orders under Federal Rule of Evidence 502(d)
  • Preservation and production challenges arising from the increasing use of messaging applications



Philip Favro, a consultant at Driven, Inc., acts as a trusted advisor to organizations and law firms on issues relating to discovery and information governance. Phil provides guidance on data preservation practices, litigation holds, data collection strategies, and ESI search methodologies. He also offers direction on records retention policies, litigation hold policies, and the need to manage dynamic sources of information found on social networks, messaging applications, and smartphones. Phil is available to serve as a special master on issues related to electronic discovery.

Phil is a nationally recognized thought leader and legal scholar on issues relating to the discovery process. His articles have been published in leading industry publications and academic journals and he is frequently in demand as a speaker for eDiscovery education programs.

Phil is a member of the Utah and California bars. He actively contributes to Working Group 1 of The Sedona Conference, where he serves as a member of the Steering Committee. Phil is the editor-in-chief of The Sedona Conference Primer on Social Media, Second Edition. He has also led drafting teams, brainstorming groups, and served as the Steering Committee project manager.

Prior to joining Driven, Phil practiced law in Northern California where he advised a variety of clients regarding business disputes and complex discovery issues. He also served as a Judge Pro Tempore for the Santa Clara County Superior Court based in Santa Clara, California.
